歐洲聯盟設計專利權(European Union Registered Community Design, 簡稱RCD)概述：
一、主管機關：歐盟市場協調局(EC Office for Harmonization in the Internal Market，簡稱OHIM)
二、可以申請RCD之設計，CDR3(a)(Council Regulation (EC) on Community designs，簡稱CDR)所稱之設計，必須顯現為產品之全部或一部份特徵，即由產品之線條(lines)、輪廓(contours)、色彩(colours)、形狀(shape)、紋理(texture)及／或材質(materials)及／或產品之裝飾(ornamentation)構成者。並於CDR3(b)規定，產品之定義為任何工業或手工產品，包含相互組合而成之複合產品(complex product)、包裝(packaging), 樣式(get-up), 圖形符號(graphic symbols)及印刷字體(typographic typefaces), 電腦程式則是除外(but excluding computer programs)。CDR3(c)規定所謂的複合產品(complex product)，指由多數能拆、裝而置換(replaced permitting disassembly and re-assembly)之組件(multiple components)所構成者。
三、RCD保護之客體，CDR37與CDIR(補充規則)2規定，申請人得於單一申請案同時申請多件設計專利權(Multiple applications)，僅是須依據設計專利權之件數，計算註冊規費與公告費。其中於CDIR2(2)並明文，申請人亦得就單一申請案中之多件設計專利權進行分案申請。
四、CDR5規定，設計專利於申請前已向公眾公開，但是如有主張優先權者，其主張之優先權日在公開之前，則例外地得被核准設計專利。且申請之設計專利如與先前技術比較僅是無關緊要之設計，亦不得被核准設計專利。
五、歐洲聯盟目前共27個會員國，包含：The Republic of Austria, The Kingdom of Belgium, The Republic of Bulgaria, The Republic of Cyprus, The Czech Republic, Demark, The Republic of Estonia, The Republic of Finland, The French Republic, The Federal Republic of Germany, The Hellenic Republic, The Republic of Hungary, Ireland, The Italian Republic, The Republic of Latvia, The Republic of Lithuania, The Grand Duchy of Luxembourg, The Republic of Malta, The Netherlands, The Republic of Poland, The Portuguese Republic, Romania, The Slovak Republic, The Republic of Slovenia, The Kingdom of Spain, The Kingdom of Sweden, The United Kingdom of Great Britain and Northern Ireland. |
